These Terms & Conditions ("Terms") govern access to and use of Artfello's digital platform, marketplace, Artfello Studio, exhibitions, physical spaces, programs, collaborations, curatorial activities, business services and related cultural and commercial activities (together, the "Services").
Artfello is a hybrid cultural and commercial platform connecting creators, collectors, businesses, cultural organisations, institutions, architects, interior professionals, hospitality and real-estate operators, partners and other participants. A user may participate in more than one capacity depending on the activity.
By using the Services, you agree to these Terms. If you do not agree, you must not use the Services.
Where more specific terms apply, the following order of precedence applies to the extent permitted by law:
If two documents conflict, the higher-ranking document prevails for the conflicting subject matter.
Users must provide accurate information, keep account credentials secure, comply with applicable law, act in good faith, respect intellectual-property rights and avoid fraud, misrepresentation, scraping, interference with the Services or misuse of Artfello branding.
Artfello may review, restrict, suspend or terminate access, listings, publishing privileges or accounts where reasonably necessary for breach of these Terms, fraud, non-payment, safety, legal or compliance concerns. Verified or approved creators may receive direct publishing privileges, but remain responsible for the legality, accuracy, availability and authenticity of everything they publish.
This section applies to recurring Artfello memberships, subscriptions, retainers and recurring participation or service programs unless a more specific agreement states otherwise.
Recurring memberships automatically renew at the end of each billing cycle for the corresponding renewal period until properly cancelled or terminated. Billing frequency and price are those shown for the selected plan or agreed service.
To prevent the next renewal, the member must give Artfello at least one (1) month written notice before the end of the current billing cycle, using an approved written communication channel. Notice received after that deadline may take effect for the following renewal cycle instead, subject always to any mandatory cancellation or consumer rights that cannot lawfully be excluded.
By purchasing a recurring membership or service, the member authorises the recurring charges disclosed at checkout or in the applicable agreement. Fees for an active billing period are non-refundable except where mandatory law requires otherwise or Artfello expressly agrees to a refund. Cancellation prevents the applicable future renewal; it does not by itself cancel payment obligations already accrued for an active period.
Artfello may suspend or terminate a membership for material breach, fraud or misuse, non-payment, or material legal/compliance risk. Outstanding payment obligations remain payable to the extent permitted by law.
Creators retain ownership of their works and intellectual property. By uploading content, a Creator grants Artfello a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, format and use that content as reasonably necessary to operate, document, market and promote the Services, the Creator, the work, exhibitions and related Artfello activities.
Creators are responsible for originality and authenticity, accurate descriptions, dimensions, condition, materials, prices, taxes where applicable, availability, delivery information and any rights needed to publish images or other content. Creators must promptly update Artfello when a listed work becomes unavailable or sells through another channel.
If a buyer orders a work that had already sold elsewhere before the order was placed, the order may be cancelled and any payment taken for that unavailable work will be refunded. Repeated failure to keep availability accurate may lead to review, unpublishing or suspension of selling privileges.
Artfello charges commission on completed sales. The applicable rate may be determined by a specific contractual creator rate, the Creator's current membership tier, or Artfello's then-current platform rate. The effective rate for an order is fixed for that order when it is created. Current membership benefits and commission rates are shown in the applicable membership information or specific creator agreement; Artfello does not guarantee that every Creator has the same rate.
Artfello Studio lets eligible Creators manage profiles, works, availability, inventory, enquiries, orders, shipping settings and other professional information. Draft or submitted content may be reviewed before publication. Where Artfello enables direct publishing for a verified Creator, that privilege does not transfer responsibility for the Creator's content or legal obligations to Artfello.
Exhibition, fair, showroom and program participation may be subject to additional written terms, deadlines and logistics. Unless a specific agreement states otherwise, Creators are responsible for arranging delivery and collection of their works within communicated deadlines. Storage charges or other consequences for uncollected work may apply only as stated in the applicable agreement and subject to applicable law.
Unless a listing or specific agreement states otherwise, the Creator is the seller of their own work. Artfello provides marketplace, discovery and payment infrastructure and facilitates the transaction.
For direct online purchases, payments are processed through Stripe using the Creator's connected Stripe account. Artfello's applicable commission may be deducted as a platform application fee. Payment services are also subject to Stripe's applicable terms and verification requirements.
Some works are enquiry-only, quote-required or otherwise not immediately purchasable. In those cases, submitting an enquiry or quote request is not itself a completed sale. A binding transaction arises only when the relevant terms are accepted and any required payment is successfully completed.
Delivery options are determined from the shipping settings associated with the work and Creator. Checkout may offer a stated delivery charge, an explicitly available free pickup option, or a delivery quote where a fixed rate cannot be calculated.
A missing shipping rate is not free shipping. Where the platform shows that a quote is required, the delivery cost must be confirmed before shipment and, where applicable, before the transaction is completed. Pickup is free only when the buyer deliberately selects an eligible pickup location offered for the relevant work or order.
Delivery estimates are estimates only unless expressly guaranteed. Customs duties, import taxes, brokerage charges or other destination charges are the buyer's responsibility unless the listing or specific agreement expressly states otherwise.
Buyers are entitled to all mandatory consumer protections that apply to them. Any additional return policy shown for a Creator or work forms part of the purchase terms for that item to the extent it is consistent with mandatory law.
Bespoke, commissioned, made-to-order, personalised or other legally exempt items may be excluded from cancellation or return rights where permitted by law. Where a return is accepted, the buyer must follow the stated return process and take reasonable care of the work. Return shipping responsibility and cost are governed by the applicable policy and mandatory law.
Refunds processed through Artfello are returned through the relevant Stripe payment flow to the extent technically and legally applicable. Nothing in these Terms limits rights that cannot be excluded under applicable consumer law.
Universities, foundations, public bodies, cultural organisations and other institutions may engage Artfello for programming, research, education, exhibitions and related projects. Project scope, responsibilities, funding, intellectual-property treatment, cancellation and payment terms may be set out in a separate agreement, which prevails for that project.
Each party retains ownership of its pre-existing intellectual property. Rights in jointly created material are governed by the applicable project agreement.
Commercial, spatial, hospitality, real-estate, brand, retail and other professional collaborations may involve project-specific pricing, deposits, milestones, technical requirements, site readiness, installation, access and cancellation terms. Scope changes may change timing and price. Completed work and costs already incurred remain payable according to the applicable agreement.
Users retain ownership of content they own. By submitting content to Artfello, they confirm they have the rights required to do so and grant Artfello the non-exclusive licence described in these Terms for operating and promoting the Services. Users must not upload content that infringes another person's rights.
The Artfello name, platform, software, visual identity and Artfello-created materials remain owned by Artfello or its licensors and may not be copied or used beyond what is permitted by law or expressly authorised.
Unless a specific written agreement expressly guarantees a defined deliverable, Artfello does not guarantee sales, enquiries, press, audience size, commercial results, representation, selection for a particular opportunity, or any specific financial or career outcome. Membership benefits are limited to the benefits expressly described for the applicable plan or agreement.
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Artfello is not responsible for indirect or consequential loss, third-party acts, or disputes between independent users, Creators, buyers, service providers or partners. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
These Terms and any dispute or claim arising out of or in connection with them or the Services are governed by the laws of Sweden, without prejudice to any mandatory consumer-protection rules that apply regardless of that choice of law.
Subject to any mandatory right of a consumer to bring proceedings elsewhere, disputes are subject to the jurisdiction of the competent courts of Sweden.
Artfello may update these Terms where reasonably necessary to reflect changes to the Services, law, payment infrastructure, commercial arrangements or operations. The current version and its update date will be published on this page. Where required by law or contract, material changes will be communicated separately and will not override accrued mandatory rights.
